1. Platform Role

Spare Marketplace ("Spare", "Company", "we", "us") operates solely as a technology platform that facilitates connections between buyers and sellers.

Spare:

  • Does not manufacture, own, store, inspect, or deliver any goods
  • Is not a party to any transaction between users
  • Does not guarantee the quality, legality, safety, or availability of any listing

All transactions are conducted solely between users.

2. User Eligibility

By using Spare, you represent that:

  • You are at least 18 years old
  • You have the legal authority to enter into agreements
  • You will comply with all applicable laws

3. No Liability for Transactions

Spare shall not be liable for:

  • Product defects, damages, or inaccuracies
  • Expired, unsafe, or contaminated food
  • Delivery failures or delays
  • Payment disputes between users
  • Personal injury, illness, or damages resulting from purchased goods

Users agree that all risk is assumed between buyer and seller.

4. Food & Perishable Disclaimer

Spare does not verify or guarantee:

  • Food safety
  • Expiration dates
  • Proper storage or handling

Buyers purchase food items at their own risk.

5. No Warranties

The platform is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, including:

  • Merchantability
  • Fitness for a particular purpose
  • Accuracy or reliability

6. Limitation of Liability

To the maximum extent permitted by law, Spare's total liability shall not exceed $100 USD.

Spare shall not be liable for:

  • Indirect, incidental, or consequential damages
  • Lost profits, data, or business opportunities

7. Indemnification

You agree to defend, indemnify, and hold harmless Spare from any claims, damages, losses, or expenses arising from:

  • Your use of the platform
  • Your listings or purchases
  • Your violation of these Terms

8. Account Suspension

Spare reserves the right to:

  • Suspend or terminate accounts at any time
  • Remove listings without notice
  • Restrict access for any reason

9. Dispute Resolution

All disputes shall be resolved through binding arbitration in the State of Florida.

Users waive:

  • Jury trials
  • Class action lawsuits

10. Governing Law

These Terms shall be governed by the laws of the State of Florida.

11. Changes to Terms

Spare may update these Terms at any time without prior notice.

Continued use constitutes acceptance.
